Chapter=20 1 General Provisions

Article 1 This Law is enacted = in order=20 to promote cleaner production, increase the efficiency of = the=20 utilization rate of resources, reduce and avoid the = generation of=20 pollutants, protect and improve environments, ensure the = health of=20 human beings and promote the sustainable development of the = economy=20 and society.

Article 2 Cleaner production as used in = this=20 Law means the continuous application of measures for design=20 improvement, utilization of clean energy and raw materials, = the=20 implementation of advanced processes, technologies and = equipment,=20 improvement of management and comprehensive utilization of = resources=20 to reduce pollution at source, enhance the rates of resource = utilization efficiency, reduce or avoid pollution generation = and=20 discharge in the course of production, provision of services = and=20 product use, so as to decrease harm to the health of human = beings=20 and the environment.

Article 3 Within the territory = of the=20 People's Republic of China, any units or individuals engaged = in=20 activities relating to production or provision of services = and their=20 corresponding management agencies must organize and = implement=20 systems for cleaner production in accordance with the = provisions=20 therefor contained in this Law.

Article 4 The nation = is=20 committed to encouraging and promoting cleaner production. = The State=20 Council and the local people's governments at or above = county level=20 must infuse cleaner production into plans and programs for = national=20 economic and social development, as well as environmental=20 protection, resources utilization, industrial development = and=20 regional development.

Article 5 The state = departments for=20 economics and trade subject to the authority of the State = Council=20 shall bear the responsibility for undertaking the work of = organizing=20 and coordinating the promotion of cleaner production = throughout the=20 nation.

The relevant administrative departments = responsible=20 for environmental protection, planning, science and = technology,=20 agriculture, construction, water conservation, and quality = and=20 technological supervision under the State Council shall = assume the=20 responsibility for promoting cleaner production in = accordance with=20 and pursuant to their respective functions and = responsibilities.=20

The local people's governments at or above county = level=20 shall be responsible for taking the initiative to promote = cleaner=20 production in the areas under their administration. The = relevant=20 departments responsible for economics and trade under the = local=20 people's governments at or above county level shall bear the = responsibility for organizing and coordinating cleaner = production in=20 the areas under their administration. The relevant = administrative=20 departments responsible for environment protection, = planning,=20 science and technology, agriculture, construction, water=20 conservation and quality and technology supervision under = the local=20 people's governments at or above county level shall be = responsible=20 for promoting cleaner production in accordance with and = pursuant to=20 their respective functions and responsibilities. =

Article 6=20 It is the policy of the nation to encourage scientific = research,=20 technical development and international cooperation to = develop=20 cleaner production, and to organize the dissemination of = information=20 with respect to and to popularize cleaner production and = extend the=20 range of cleaner production technologies.

The nation = is=20 committed to encouraging social groups and citizens to = participate=20 in the dissemination of public awareness with respect to = cleaner=20 production through education, popularization, implementation = and=20 supervision.

Chapter 2 Realization of Cleaner = Production=20

Article 7 The State Council shall formulate fiscal = and tax=20 policies conducive to the implementation of cleaner = production.=20

The State Council and other relevant administrative=20 departments having corresponding responsibility and the = people's=20 governments of provinces, autonomous regions and = municipalities=20 directly under the central government shall formulate and = implement=20 beneficial industrial development policies and technological = development and popularization policies and undertake = supervision=20 and management measures conducive to the implementation of = cleaner=20 production.

Article 8 The above departments = responsible for=20 economics and trade under the people's governments at or = above=20 county level shall formulate plans for the popularization of = cleaner=20 production jointly with relevant departments responsible for = environmental protection, planning, science and technology,=20 agriculture, construction and water conservation. =

Article 9=20 The local people's governments at or above county level = shall=20 formulate plans rationally for regional economic blueprints = and=20 readjust industrial structures to enhance adherence to a = recycling=20 economy and promote active enterprise cooperation in the=20 comprehensive utilization of resources and waste products, = thus=20 ensuring high-efficiency utilization and recycling of = resources.=20

Article 10 The relevant administrative departments = having=20 responsibility for economics and trade, environmental = protection,=20 planning, science and technology and agricultural in the = State=20 Council and the people's governments of the provinces, = autonomous=20 regions and the municipalities directly under the central = government=20 shall exert their organizational efforts and provide support = for the=20 establishment of cleaner production information systems and=20 technical consulting and services system to provide the = public with=20 information with respect to methodologies and technologies = relating=20 to cleaner production, and information and services relating = to=20 supply and demand for renewable and recyclable waste = products and=20 cleaner production policies.

Article 11 The relevant = departments for economics and trade under the State Council, = together with related departments having coordinate = responsibility,=20 shall periodically release guidance catalogues on cleaner = production=20 technologies, processes, equipment and products.

The = relevant administrative departments responsible for = economics and=20 trade, environmental protection, planning, science and = technology,=20 agriculture and construction in the State Council and the = provincial=20 people's governments, autonomous regions and municipalities = directly=20 under the central government shall organize the compilation = of=20 industry- or region-specific cleaner production guidelines = or=20 technical manuals illustrating methods for the = implementation of=20 cleaner production.

Article 12 The nation shall = implement a=20 time-limited system for the elimination of obsolete or = obsolescent=20 production technologies, processes, equipment and products = gravely=20 hazardous to environments and wasteful of resources. The = relevant=20 departments for economic and trade under the State Council = shall=20 issue a directory of production technologies, processes and=20 equipment and products to be eliminated within the time = limit,=20 jointly with other relevant administrative departments in = the State=20 Council.

Article 13 The responsible administrative=20 departments under the State Council may approve the = establishment of=20 a product labeling system in accordance with need in the = fields of=20 environmental and resource protection such as energy = conservation,=20 water conservation, waste reuse and recycling, and devise = the=20 relevant standards according to the national requirements.=20

Article 14 The relevant administrative departments=20 responsible for science and technology and other relevant=20 administrative departments under the people's governments at = or=20 above county level shall guide and support research into and = development of cleaner production technologies and products=20 beneficial to protection of the environment and resources, = as well=20 as demonstrating and popularizing cleaner production = technologies.=20

Article 15 The relevant administrative departments=20 responsible for education under the State Council shall = integrate=20 relevant courses of study on cleaner production technologies = and=20 management into higher education, professional education and = technical training programs.

The relevant = administrative=20 departments under the people's governments at or above = county level=20 having responsibility in this area shall organize to engage = in the=20 dissemination of information and training relative to = cleaner=20 production, in order to raise the level of awareness = regarding=20 cleaner production among government officials, enterprise = managers=20 and the public and provide training in cleaner production to = management and technical personnel.

News publishers, = TV and=20 film broadcasters, and units engaged in the dissemination of = cultural content and related social organizations shall = avail=20 themselves of their respective advantageous positions to = disseminate=20 information regarding cleaner production.

Article 16 = Governments at all levels shall give priority to purchase = products=20 conducive to energy and water conservation, waste reuse,=20 environmental protection and resource conservation.=20

Governments at all levels shall engage in the = measures of=20 publicity, education or training to encourage the public to = purchase=20 and use products conducive to energy and water conservation, = waste=20 reuse, environmental protection and resource conservation.=20

Article 17 The relevant departments responsible for=20 environmental protection in the people's governments of the = various=20 provinces, autonomous regions and municipalities directly = under the=20 central government shall enhance their supervision of the = process of=20 implementation of cleaner production. In accordance with = their needs=20 of promoting cleaner production, these governments may = publish a=20 list of the names of heavily-polluting enterprises in local = primary=20 media based on the pollution discharge conditions of such=20 enterprises, where the pollutants discharged exceed the = standards or=20 the total volume of pollutants exceeds regulatory limits, in = order=20 to provide the public with a basis for policing enterprise=20 implementation of cleaner production.

Chapter 3=20 Implementation of Cleaner Production

Article 18 New=20 construction, construction renovation and expansion projects = shall=20 conduct environmental impact assessments with respect to = analysis=20 and assessment of use of raw materials, resource = consumption,=20 comprehensive utilization of resources, as well as = generation of=20 pollutants and their treatment; shall accord priority to = adopting=20 cleaner production technologies, processes and equipment, = which=20 maximize the resource utilization rate and generate few = pollutants.=20

Article 19 Enterprises in the course of = technological=20 upgrades shall adopt the following cleaner production = measures:=20

Adopting toxin-free, non-hazardous or low-toxin and = low-harm=20 raw materials to replace toxic and hazardous raw materials;=20

Adopting processes and equipment with high resource=20 utilization rates and little pollutant-generation to replace = processes and equipment with high resource consumption and=20 significant generation of pollutants;

Comprehensive = use or=20 recycling of materials such as waste products, waste water = and heat=20 generated from production procedures.

Adopting = pollution=20 prevention and control technologies sufficient to permit the = enterprises to comply with national or local pollution = discharge=20 standards and total volume control quotas for pollutants.=20

Article 20 When products and packaging are designed, = their=20 influences on mankind and natural environments during their=20 life-cycle must be considered and priority accorded to = selecting=20 toxin-free, non-hazardous, easily degraded and easily = recycled=20 options.

Enterprises should package the products in = a=20 reasonable manner to reduce the overuse of packaging = materials and=20 reduce the generation of packaging wastes.

Article = 21 Any=20 enterprise producing large-sized electromechanical = equipment,=20 motor-driven transport apparatuses, and other any products=20 designated accordingly by the relevant departments for = economic and=20 trade under the State Council shall place the standard label = listing=20 material composition on a main structural component of the = product=20 in accordance with the technical specifications therefor = devised by=20 the relevant administrative department responsible for such=20 standardization under the State Council or its duly = authorized=20 organizations.

Article 22 Agricultural producers = shall use=20 chemical fertilizers, pesticides, agricultural films and = feed=20 additive compounds in accordance with scientific principles, = improve=20 planting and breeding techniques so as to bring about = high-quality,=20 non-hazardous agricultural products and generate resources = from=20 wastes from agricultural production and prevent and control=20 agricultural environmental pollution.

The use of = toxic or=20 hazardous wastes as fertilizer or as fill to build up fields = is=20 prohibited.

Article 23 Enterprises purveying = services, such=20 as restaurants, places of entertainment, hotels, etc., shall = adopt=20 measures for energy and water conservation and other=20 environmentally-friendly technologies and equipment and = reduce or=20 avoid the use and consumption of goods which waste resources = and=20 pollute the environment.

Article 24 Construction = projects=20 shall adopt the design options, construction and decoration=20 materials, construction structures, fixtures and equipment = resulting=20 in energy and water conservation and other = environmentally-friendly=20 and resource-conserving construction planning options.=20

Construction or decoration materials must comply = with=20 national standards therefor. The production, sale and = utilization of=20 any construction or decoration materials containing toxic or = hazardous content exceeding national standards therefor is=20 prohibited.

Article 25 Mining exploration and = exploitation=20 activities shall adopt methods and technologies geared = towards=20 reasonable utilization of resources, environmental = protection and=20 pollution control and prevention, to increase the = utilization level=20 of resources.

Article 26 To the extent economically = and=20 technically feasible, enterprises shall recover and utilize = their=20 own wastes or wasted heat generated from the processes of = production=20 and/or provision of services or transfer these wastes to = other=20 enterprises or persons with the ability to do so. =

Article 27=20 If any product or package is listed in the compulsory = recycling=20 directory, enterprises engaged in their production or sale = shall=20 recycle the discarded product or used packaging. The = relevant=20 department for economics and trade under the State Council = will=20 formulate the compulsory recycling directory of products and = packages and its detailed methods for recycling.

The = state=20 will devise economic measures favorable to recycling and = utilization=20 of the products and packages listed in the compulsory = recycling=20 directory; the relevant departments for economics and trade = under=20 the local people's governments at or above county level = shall=20 periodically monitor the implementation conditions of the = compulsory=20 recycling products and packages, and make timely reports to = the=20 public regarding the results of such monitoring. The = relevant=20 departments for economic and trade under the State Council = shall=20 formulate concrete methodologies to effectuate these = objectives.=20

Article 28 Enterprises shall monitor resource = consumption=20 and generation of wastes during the course of production and = provision of services, and conduct cleaner production audits = with=20 respect to production and service procedures according to = need.=20

Enterprises that exceed the national or local = discharging=20 standards or exceed the total volume control targets for = pollutants=20 set by the relevant local people's governments shall conduct = cleaner=20 production audits.

Any enterprise using toxic and = hazardous=20 materials in production or discharging toxic and hazardous=20 substances shall periodically conduct cleaner production = audits, and=20 report the audit results to the relevant administrative = departments=20 for environmental protection and the relevant departments = for=20 economic and trade under the local people's government at or = above=20 county level.

The administrative procedures for = conducting=20 cleaner production audits shall be formulated by the = relevant=20 departments for economic and trade under the State Council = jointly=20 with the relevant administrative department for = environmental=20 protection under the State Council.

Article 29 After = an=20 enterprise attains a national or local discharge threshold = standard,=20 the enterprise may enter into a voluntary agreement or = agreements=20 for further resource conservation and pollution discharge = reduction=20 with the relevant local administrative departments = responsible for=20 economics and trade, and the relevant administrative = department=20 responsible for environmental protection. The relevant local = administrative departments for economics and trade, and the = relevant=20 administrative departments for environmental protection = shall=20 publicize the name of the enterprise and the results of its = resource=20 conservation and pollution control and prevention in the = primary=20 local media.

Article 30 Enterprises may voluntarily = submit=20 applications for certification to state-authorized = certification=20 organizations, in accordance with the regulations = promulgated=20 pursuant to the national environmental management = certification=20 system, to qualify under the environmental management = certification=20 system standards as having improved the cleaner production = tableau.=20

Article 31 In accordance with the provisions of = Article 17=20 of this Law, enterprises appearing on the list of names of=20 enterprising generating significant pollution, in accordance = with=20 regulations promulgated by relevant departments responsible = for=20 environmental protection under the State Council, must = periodically=20 publicly publish the status of their discharge of their = major=20 pollutants, and submit to public supervision. =

Chapter 4=20 Inducement Measures

Article 32 The Nation = establishes a=20 system of commendation and reward for cleaner production. = The=20 people's governments shall give commendations and rewards to = those=20 units and individuals that have made conspicuous = achievements in the=20 work of realizing cleaner production.

Article 33 = With=20 respect to conducting cleaner production research, = demonstration=20 projects and training, implementing key national cleaner = production=20 technological innovation projects and implementing = individual=20 technological innovation projects listed in the voluntary = pollutant=20 reduction agreements entered into per the provisions of = Article 29=20 of this Law, the above activities and projects shall fall = within the=20 scope of the support parameters of the Special Technological = Development Funds set aside by the fiscal management = departments of=20 the State Council and its coordinate local people's = governments at=20 or above county level.

Article 34 Funding from the = Small-=20 and Medium-Sized Enterprise Development Fund established in=20 accordance with national regulations shall be set aside to = support=20 cleaner production for small- and medium-sized enterprises = in=20 accordance with their needs.

Article 35 With respect = to=20 products produced from wastes and materials reclaimed from = wastes,=20 the taxation authorities shall reduce or exempt these from=20 Value-Added Tax in accordance with relevant national = regulations.=20

Article 36 Expenses incurred for cleaner production = auditing=20 and training may be booked as enterprise operating costs.=20

Chapter 5 Legal Liability

Article 37 If any=20 enterprise or individual violates the provisions contained = in=20 Article 21 of this Law or fails to affix a label stating the = material composition, or fails to provide such information=20 truthfully and accurately, the relevant departments = responsible for=20 quality and technological supervision under the people's = government=20 at or above county level shall order such party to make=20 rectification within a specified time limit and may further = impose a=20 fine in an amount not to exceed RMB 50,000 yuan. =

Article 38=20 If any enterprise or individual violates the provisions = contained in=20 the second paragraph of Article 24 of this Law by producing = or=20 selling toxic or hazardous construction and decoration = materials=20 whose toxicity or degree of hazard exceeds the national = standards=20 therefor, such enterprise or individual shall be prosecuted = in=20 accordance with the corresponding respective administrative = law,=20 civil law or criminal law.

Article 39 If any = enterprise or=20 individual violates the provisions contained in the first = paragraph=20 of Article 27 of this Law, and fails to discharge the = product or=20 package recycling obligations corresponding thereto, the = relevant=20 departments responsible for economics and trade under the = people's=20 government at or above county level shall order such party = to make=20 rectification within a specified time limit, and may further = impose=20 a fine in an amount not to exceed RMB 100,000 yuan if the = party=20 fails to make rectification.

Article 40 If any = enterprise or=20 individual violates the provisions of the third paragraph = contained=20 in Article 28 of this Law, fails to implement cleaner = production=20 auditing, or has conducted cleaner production auditing but = fails to=20 accurately report the results thereof, the relevant = departments=20 responsible for environmental protection under the people's=20 government at or above county level shall order such party = to make=20 rectification within a specified time limit, and may further = impose=20 a fine in an amount not to exceed RMB 100,000 yuan if the = party=20 fails to make rectification.

Article 41 If any = enterprise or=20 individual violates the provisions contained in Article 31 = of this=20 Law, or fails to publicly publish, or fails to publicly = publish in=20 accordance with the requirements therein its pollutant = discharge=20 information, the relevant departments responsible for = environmental=20 protection under the people's government at or above county = level=20 shall publish the subject information relative to the = circumstances=20 of such party's pollutant discharge, and may further impose = a fine=20 in an amount not to exceed RMB 100,000 yuan.

Chapter = 6=20 Supplementary Articles

Article 42 This law shall = come into=20 effect as of January 1, 2003.
